[SOLVED]
this was solved by:

Disable Direct Rendering Manager (https://wiki.gentoo.org/wiki/NVIDIA/nvi ... ot_enabled)

add user (you) to the "video" group (https://wiki.gentoo.org/wiki/NVIDIA/nvi ... ermissions)

A quick search shows most of the time this occurs because the Nvidia driver is not actually in use (such as in a hybrid graphics situation the nouveau driver is being loaded instead) or when someone is attempting to use the machine remotely.
Maybe you can provide some more information about your setup.
Does this machine have hybrid graphics (or only one Nvidia GPU)?
Can you confirm that the Nvidia proprietary driver is in use (as opposed to nouveau)?
Is this a custom kernel or a stock kernel?
What is the output of:

Does nvidia-smi or nvidia-settings appear normal or offer any output that might give any useful information?
Have you reviewed the wiki to make sure you have configured everything correctly?

1.Yes my machine only have 1 dedicated GPU (nvidia)

3.This is stock kernel (gentoo-kernel-dist) with Nouveau unbulit to the kernel (using snippet - # CONFIG_DRM_NOUVEAU is not set)
4.nvidia-smi appears to be nornal and nvidia-settings will open a gui-setting panel for nvida
4.I can't confirm configuration is correctly configiured because i'm using a Distrubition kernel (not binary)
