Dev question about linuxant license

Hello, I'm hoping you could give me some advice about the linuxant hcfpcimodem. Are there any restictions on redistribution/modification of code contained within the free beta drivers available in portage?

To make it a little bit clearer, I originally obtained a beta driver from linuxant about 2 years ago (for my redhat 7.3 box) when these drivers were free. I patched this driver a bit later on to work on RH9 (works with gentoo as well) and would like to release the patch. As this driver only works on 2.4 series kernels there probably isn't much use for it but I would like to make it available on my website anyway.

Linuxant drivers are now licensed (and not free) so ....
Am I allowed to do this with their old (non-license and free) drivers?

There should be a lisence agreement somewhere in the original collection of files. You should find your answer in there. Tha fact that they changed the lisence for newer versions does not change it for the one you have.
