When I try to emerge apache2 with the SSL USE flag the emerge will fail with the following:

I have a feeling this has to do with openssl but re-emerging makes no diffrence.

It also looks like openssl will give me a segmentation fault when I attempt to use it manualy.

Try revdep-rebuild and update all config files.

There's your solution, check your kernel .config

I ran revdep-rebuild and made sure that all of the configs were updated.

The CONFIG_SYSVIPC=y was set.

However apache still will not build :(

No, that is not the problem. The Apache ebuild does not examine the kernel configuration. That is printed as a helpful warning, without regard to whether the user has already configured the kernel correctly. You can find the message and associated comment in /usr/portage/eclass/apache-2.eclass.

jsnaza: the failure in the script is probably just a consequence of openssl crashing when you run it. I suspect if you fix that, then the script will start working. Please follow How to get meaningful backtraces in Gentoo, rebuild openssl with symbols, then provide a backtrace when it crashes. Also, what is the output of emerge --info?
