This probably because forums has problem with patch because does not properly maintain spaces and tabs

You could instead copy the patch from the post. Start a reply-with-quote to the person who posted the patch. In the multiline edit box on the reply page, whitespace is handled properly. Copy the patch text from the quoted response, then abandon posting the reply.

I wonder if this will get rolled into the ebuild? Does anybody know if an actual bug report was opened?

We are at 5.5.2 kernel at the moment, there's a working patch but the important thing is that the bug report is opened.
Let the users patch that by hand, there's no need to have that patch in the tree.
Maybe the problem will magically fix itself with 5.6.0

It's not a kernel problem but a virtualbox-modules problem because at current 6.1.2 version not support kernel >=5.5

Okay, but the problem still remains, that's the point I was trying to make.

There are numerous bug reports still open with the similar problem, someone posts a patch in the report, more people reports that it's fine but it doesn't end up in the portage and the bug remains open.

Because the main developers policy is to wait that upstream release a version for the problem.

Are you sure that virtualbox-modules-6.1.4 not support kernel>=5.5?
