it fails at install phase:

I have checked this dir and found the file with the different filename "75_mod_perl.conf.2.2"...

I'm getting the same emerge error:

Yes, I have emerged ~mod_perl-2.0.8-r2, but I was forced to allow emerge also for ~www-servers/apache-2.4.12; ~dev-libs/apr-1.5.2; ~app-admin/apache-tools-2.4.12. And then had an headache how to start backuppc on that server again :), because its httpd.conf works only with apache22.

Right. There's always at least a package that breaks whenever a major piece of software is upgraded.
BTW you should file a bug report at bugs.gentoo.org if you believe that backuppc won't work with apache 2.4 (unless it's only a config issue).
Otherwise, when apache 2.4 goes stable, many users who use backuppc in the stable branch will start complaining.

Anyway, if you don't want to use ~ mod_perl then you can revert to apache 2.2, etc., by simply renaming the file mod_perl conf file to:
/usr/portage/www-apache/mod_perl/files/2.0.3/75_mod_perl.2.2.conf
(as you already noticed yourself in your first post)

You can either wait for the bug to be fixed (https://bugs.gentoo.org/show_bug.cgi?id=550638) or create your own ebuild and emerge mod_perl from there (/usr/local/portage) or even rename the file in /usr/portage directly, just as long as you don't need to re-emerge mod_perl after you emerge --sync (unless the gentoo devs fix the bug).

Downgrade apache et al., remove portage keywords and:

Thank you for advice, Vieri. I have tried just rename that file, but got emerge error, because that file is not described in Manifest.

I see they have fixed this issue already https://bugs.gentoo.org/show_bug.cgi?id=550638

Regarding BackuPC, the only problem is that httpd.conf inside /etc/BackupPC is old fashion and not suitable for apache24, hope they will fix it prior to make apache24 stable. Should I report this issue?

Just inform the BackuPC devs of the deprected httpd.conf file and hope they adjust it to apache 2.4.
