This is my bashrc:

}
How can I conditionally prevent epatch_user from being called based on an EAPI version ?

Unfortunately, it does not depend on the EAPI whether epatch_user is available but whether eutils is inherited (directly or indirectly). You can test whether epatch_user is available:

  case `type -t epatch_user` in
  function) epatch_user;;
  esac
}
