ok.. was using an older version of teamspeak threw the portage tree.
updated to "media-sound/teamspeak-client-bin-3.0.10"
the teamspeak program says (even as root)

TeamSpeak 3 cannot write to the configuration file:
You can use TeamSpeak 3, but all settings will be lost

but it gives me the option to ignore and continue. so i do,
and the console says this

as root, or sudo, or regular user. the sql would be how it saves the settings, but it was working before the update.. not even
sure how to reset that up. i'm pritty sure it did it during the emerge last time.
(I DO NOT use pulseaudio...) |

i am not using any additional use flags for teamspeak...
my make.conf is using
