When I googled this issue, it seemed to only exist in a much older kernel, the post was from 2003 and was involving kernel version 2.4.*.

It's now 2012 running kernel 3.2.1-gentoo-r2 and I'm getting the same error:

I found this error when I was trying to change grub to load a newly compiled kernel. I wound up using a mix of my local terminal at my desk and the "cat" command to get the job done. I'm now on kernel 3.3.8-gentoo and nano is working fine. I hope this helps someone's sanity later.
