Yes there is difference, but at its core both scenarios about you getting a free ride at an expence of a business.

Copyright law was not created to protect businesses. It was created to protect content creators (primarily authors) from businesses. See, what used to happen was that someone would write a book, and get it published in London or Paris. Then an American publisher would come along, copy the book and start distributing it, without giving any money to the original author.

More books the store sells, more money will the author get. So you get free ride at an expence of all parties envolved in the book.

Also, why is it alright for Jackass to have copyright? I thought it was the most stupid thing BobP did, it should have been all GPL/CCSASA

If Jackass were not protected by copyright, it couldn't be properly redistributed under the GPL or CCASA anyway, since without copyright anyone would be able to do whatever they wanted with it.
the CCSASA could be it's copyright license

Eh?

No no no. See, copyright is the thing that stops people from arbitrarily taking work and doing with it whatever they want. Licences like the GPL and CCASA give out additional rights which go beyond those normally allowed by copyright law. However, two important things:

* If Jackass were not copyrighted, the GPL and CCASA can't apply to it.
* If there were no such thing as copyright law, the GPL and CCASA couldn't apply to anything.

The GPL and CCASA don't replace copyright. They merely give people additional rights to an already copyrighted work.

I think the problem people have with it was it was Copyright Bob Perandia and he didn't agree to license it in any way, which a few of us felt that it was out of order

Do you think people should have to agree (with a checkbox) to the Creative Commons Share and Share Alike to be able to post?

Here's my objection. Why must I agree to CC? what if I want to use GFDL? or BSD over GPL?

If I created the orginal work, why can't I choose how to copyright it?

Don't know if this has been mentioned yet, but: You're saying I can claim royalties from people who quote me?

Nope. See "Fair Use".
