i have got a 60gb IBM hdd
my current partition table looks like this

/dev/hda1 5gb Win95 FAT32 Wíndows XP
/dev/hda2 44gb Win95 FAT32 Ext`d (LBA)
/dev/hda3 100mb Win95 FAT16 /boot
/dev/hda4 500mb Win95 FAT32 /swap
/dev/hda5 44gb Win95 Fat32 Files

i plan to use hda3 for boot and hda4 for swap
my problem is i cannot create another partition for /root
No free sectors available
the extended partition is just 44gb
any way how i can fix this mess without loosing my data on /dev/hda5 ?

Anytime you mess with the partition table, you should have all data backed up (unless you don't care if it goes bye-bye). So, if we assume you've backed up your data, you can then change partitions around safely :D

Honestly... if you really don't want to lose the data, copy it to some CDs or another HD. Oterwise you'll be very upset if someting goes wrong and you lose it.
